What Is a Cease and Desist Letter?
A cease and desist letter is a formal written demand that someone stop doing something: harassing you, using your work, contacting you, trespassing, or spreading false statements. It is sent by you or on your behalf, states the conduct, demands that it stop by a deadline, and warns of legal action if it does not.
It is not a court order. Nothing happens automatically if the recipient ignores it. Its power comes from what it changes: after the letter, the recipient can never claim they did not know, and every continued incident becomes evidence of knowing, deliberate conduct.
What a cease and desist letter actually does
First, it stops a surprising amount of behavior outright. Most people have never received a formal legal demand, and the letter forces a sober cost-benefit calculation that a text message never will.
Second, it builds your record. Courts, police, and agencies respond to documentation. A dated letter, delivered by certified mail, plus a log of what happened afterward, is the foundation of restraining order petitions, small claims cases, and civil suits.
Third, it satisfies expectations. Judges expect to see that you demanded the conduct stop before you filed anything. The letter is how you show you acted reasonably.
When to send one
Send a cease and desist letter when informal requests have failed and the conduct is continuing: harassment, defamation, copyright or trademark infringement, debt collector contact, trespassing, or neighbor nuisance. If you are in physical danger, call the police first; letters are for conduct, not emergencies.
What belongs in it
The essentials: who you are, what the conduct is, specific dated incidents, the demand itself, a compliance deadline, and a statement that you will pursue legal remedies if ignored. Keep the tone firm and factual. Threats you cannot carry out and insults both weaken the letter.
